Construction Contractors: Qualifying Agent Responsibilities

To “qualify a business” means the contractor has agreed to accept full responsibility for the business, including financial transactions, signing permits, and supervising all jobs the business participates in. If you are the primary qualifying agent, you are responsible for your business.

If your company designates a financially responsible officer to take financial responsibility for the company, that individual must complete the Financially Responsible Officer (FRO).This will alleviate the licensed qualifier’s financial responsibility, but the qualifier will still be responsible for all construction-related matters.

Per Florida Statute, the qualifying agent has final approval authority for all construction work performed by the business organization and thas final approval authority on all business matters, including contracts, specifications, checks, drafts, or payments, regardless of the form of payment, made by the business organization, except where a financially responsible officer is approved.
